(The Supreme Court today effectively expanded the right of local governments to seize private property under eminent domain, ruling that people's homes and businesses -- even those not considered blighted -- can be taken against their will for private development if the seizure serves a broadly defined "public use."
In a 5-4 decision, the court upheld the ability of New London, Conn., to seize people's homes to make way for an office, residential and retail complex supporting a new $300 million research facility of the Pfizer pharmaceutical company. The city had argued that the project served a public use within the meaning of the Takings Clause of the Fifth Amendment to the Constitution because it would increase tax revenues, create jobs and improve the local economy.)

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury, except in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.
-The defining factor of America has always been the ability to own your own property. Although that has been arguable in the past (if you don't pay your taxes they take your property) it is undeniable now. 5 tyrants out of 9 USSC justices just gave any level of government the "right" to take your property for the ability to raise tax revenues. How far do we let this go?

Private property rights went out the window in this country when they allowed property to be taxed. There is no such thing as private property anymore, and arrogant judges are unaccountable for their actions. It's not just the courts. Here in Oregon we voted in an initiative that required govt agencies to reimburse land owners when regulation reduced the value of their property. It was voted in by a pretty healthy margin, but the legislature and bureacrats are doing everything possible to gut it. Our "public representatives" really do think we are their slaves, but by handing out our money they keep getting elected. We have met the enemy and he is us. ....

When the US Park Service stole our best property we of course felt like we were just punched in the guts. BUT, at least that property as well as our neighbors property is and will be used for the public good.
This case, which obviously benefits developers first is obviously wrong, whether it is legal or not. I find it interesting (but not surprising) that the 5 most liberal judges voted for the municipality position and the 4 most conservative voted for the landowners.

That's why the liberals want to take our guns away, so we can't fight back. Those city council members wanting to do this development must have their hands in the til somewhere.
In my small town USA, the city tried pulling some of that stuff. There was a public outcry that led to death threats to all city council members. People boycotted their businesses and they were voted out the next election. New members are very concerned about doing questionable and non-ethical things. ....

They're doing it in little ways to all of us. They're micromanaging zoning so you have so little freedom of what you can do on your own property. If you have "wetlands" forget about having say in what you do with your own land. Try to fix up your property & you'll be paying a fortune in permit fees (and lousy code inspections). They keep upping prop taxes; it so high now it's forcing oldtime farmers to sell out to developers.
You can spend your whole life working to buy & keep up your home, and the government can just pluck it away from you one way or another. Thank you big government (sarcasm) ....

And while government takes your money and your land under the guise of taxes and eminent domain with one hand, they use the other hand to point the finger of corruption and greed at "big business" and "evil corporations".
Last time I checked, when a business gets my money, I get something back. When government takes my money they give it to someone who won't work, or they use it to feed breakfast to already overweight school children.

The 5 SCOTUS judges who voted to violate our 4th & 5th amendment rights are no better and maybe even worse than the terrorists we are supposedly at war with. They employ the same methods and actions. If you doubt my statement; try disregarding or violating a court order such as this or use "effective means" to protect your property and watch how fast the "JBT's" show up to take your property at gun point. It is time for impeachment procedings to begin to remove these left wing extremist criminals from the SCOTUS bench. If this ruling is allowed to stand it will unravel the bond that holds this nation together. Ownership of private property is the foundation upon which our nation stands. John Paul Stevens,Anthony Kennedy, David H. Souter, Ruth Bader Ginsburg and Stephen G. Breyer may well have lit the fuse to anarchy and civil uprising in our future.
In my opinion there is ONE judge on the Supreme Court who understands the Constitution of the United States and the would be judge Scalia. Clarance Thomas I view as a moderate liberal socialist; the rest are left wing radical extremists.

I found this story while I was muddling about. It seems that someone is trying to use "eminent domain" to take Justice David Souter's house from him. I'm sure it won't happen but it would certainly be justice served.

Don't be fooled by all of this........it is way beyond that now. The Supreme Court is flirting with making itself TOTALLY irrelivant......if you can imagine that. Answer me this question.........would you stand by and peacefully allow the JBT's to come and steal your home at gun point and put your family out on the street. The "fair market value" (which by the way has ABSOLUTELY NOTHING in ANYWAY with the "JUST COMPENSATION" the 5th ammendment REQUIRES) will certainly not cover anywhere near your costs to relocate and rebuild to your satisfaction. ....

As strange as it may sound, I actually enjoyed paying my mortgage. We put a little more toward the principle, calculate when the last payment will be and thank God we have the ability to do all this. This ruling sent chills down my spine, and the feeling of actually owning the house at the end has become a fallacy. ....
